You are asked to agree to these terms and conditions before using the YourStudentHouse website and its services. Please read them carefully. If you do not agree to them, please do not use YourStudentHouse. In using the YourStudentHouse website you indicate your acceptance of these terms and conditions.

1) Definitions and interpretation

"The website" means YourStudentHouse.

"Registered user" means the relevant person who chooses to use this website. Whether it be a landlord, estate agent, or private halls of residence company.

"Terms" is the name used to refer to these Terms and Conditions.

2) Introduction

Please note that we will not file a copy of these terms. We may update the version on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms for your records.

These terms apply to a registered user who chooses to use the website.

Each registered user must comply and adhere to these terms in order to access and use the website.

A registered user may add properties to the website, edit the details they have given, upload images to the website of their properties and view statistics of how many people have viewed their property details. If the advertising package allows, for each property listing a registered user may also upload an advertising banner. Banners can advertise either their property or company and will link directly to the property listing associated with that banner.

3) Requirements and Responsibilities of Registered Users

Each registered user who submits details onto the website is responsible for complying with the following standards.

a) All information must be legal, honest and decent.

b) The Data Protection Legislation within the English law must be adhered to.

c) The details are accurate and genuine.

d) The property advertised is of reasonable student accommodation quality and is suitable for human habitation.

e) A reputable advertising agency should find no reason in which they would decline to be associated with the advertising of the property.

f) The Registered user is the owner of the property advertised or has written permission from the owner(s) to advertise that property.

g) The publication of the details will not violate or infringe the rights of any third party, including copyright, trademark, privacy or other personal or property rights.

Each registered user is solely responsible for their details and will be solely liable for false, misleading, inaccurate, infringing or other actionable details contained or referred to therein.

Each registered user is responsible for the use and confidentiality of their username.

No registered user may advertise anything other than property details or company details on the website without prior permission in writing from the website owner.

4) Price and payment

After any free trial period if the registered user chooses to continue using the website services, payment can be made either online or via post. Online payments must be made by credit card, debit card, or Paypal by the Paypal payment facility. Payments via post can be made by cheque, postal order or bankers draft.

Prices for services are liable to change at any time, but changes will not affect current agreements.

No contract shall arise between a registered user and the website owner until the registered user has successfully completed the online Payment Procedure relevant to the chosen advertisement package. At this point a binding contract will be formed between the registered user and the Website owner.

The Website accepts credit card payments by an online Payment Procedure through a secure hosting server called Paypal.

If a registered user chooses to pay via Credit card, details are held in the Paypal payment system and are not retained on the website's server. The website never has the ability to view or store credit card details.

5) No transfers

You may not assign, charge, sub-contract or otherwise transfer this agreement, or any of your rights or obligations arising under this agreement. Any attempt by you to do so shall be null and void. We may assign, charge, sub-contract or otherwise transfer this Agreement, or any of our rights or obligations arising under this agreement, at any time. In this case the guarantees benefiting a registered user under this agreement will not be harmed.

6) Termination

The Website Owner reserves the right to terminate the contract and remove your property details at any time. This might be for breach of any of the requirements stated in Section 5 above or for any other reason at the absolute discretion of the Website Owner.

For as long as a registered user continues to use the services of the website, they agree to remain bound by the terms (as amended from time to time).

7) Refunds

In the event that the Website Owner exercises its termination rights, it will award a registered user a pro-rata refund.

In the event of the Website suffering a substantial period of downtime or repeated short periods of downtime the Website Owner may, at its absolute discretion, give a pro-rata refund to the registered user.

The two above statements are without further liability to the registered user in any respect.

8) Limitations of liability

The website owner shall not be liable to a registered user for:

a) Any indirect, consequential, special or punitive loss, damage, costs and expenses;

b) Loss of profit;

c) Loss of business;

d) Loss of reputation;

e) Depletion of goodwill; or

f) Loss of, damage to or corruption of data. Including, but not limited to, property details entered onto the website in the control panel.

The Website Owner does not warrant the content, accuracy or sincerity of any details or other information on the Website, the responsibility for which rests with each registered user.

A registered user acknowledges that the website may contain bugs, errors and other problems that could cause systems failures. Consequently, the website is provided "AS IS", without a warranty of any kind.

The Website contains links to other Internet sites and resources. The Website Owner is not responsible for the contents or the availability of these external resources.

9) General terms

We will treat all your personal information that we collect in connection with your account in accordance with the terms of our Privacy Policy.

This Agreement is made under and will be governed by the laws of England. A registered user and the website owner hereby submit to the non-exclusive jurisdiction of the English Courts.
